The Terms and Conditions stipulated herein are legally binding agreement between Bibliocracy.com and it's owner and you the member. In agreeing to use this site, purchase services or products from Bibliocracy.com you agree to abide by all rules and regulations, all constraints and restrictions, and that as a member you have read, understood and unconditionally accepted the terms and conditions clause in its entirety. All terms, conditions, restrictions, constraints and exemption of liabilities, were put in place to protect the site owner and its members, from misuse, abuse, illegal use of site resources, and pertains to terms and condition clauses that and which Bibliocracy.com deems as equitable to both parties.

In using this site to publish an eBook, or Cover Art you thereby understand that you the member give full rights to Bibliocracy.com and its owner the permission to publish and sell your eBook or Cover Art on the site. Where you the member choose a price within the range stipulated by Bibliocracy.com. In return for your service rendered (as a granted right to sell your eBook or Cover Art upon uploading to Bibliocracy.com) you get a percentage of that sale, as stipulated on Bibliocracy.com. That percentage can and may change at any time at the site owner’s discretion. Equally, you the member can retrieve the eBook or Cover Art in its entirety from the site, or choose to terminate and delete your account with us at any time. You publish your eBook on Bibliocracy.com at your discretion, and use our services in agreement that the site owner is allowed to sell your work as long as it is kept on the site.

Creating more than one Bibliocracy.com account is prohibited. By joining Bibliocracy.com all members are aware and accept that creating and managing multiple accounts is a serious violation of our Terms of Use. If we determine that an individual has more than one account, we reserve the right to terminate all of their accounts. Maintaining multiple accounts, regardless of the purpose, is a violation of Bibliocracy.com’s Terms and Conditions.
 

A. Stipulated Clauses

You being the member agree to the following:

A1 – Under no circumstance shall you transfer copyright material from any other source other than your own. A writer’s or artist’s work is considered proprietary and intellectual ownership. Upon accepting these terms you agree that all work submitted is your own, and does not belong to someone else (including but not limited to a Company, another entity, etc) and that you have proof to support that evidence, at any given time, should anyone make a claim against your work.

A2 – That you understand and agree that by submitting your work on our site is not by itself proof of copyright.

A3 – We will not accept any material where a third party holds exclusive rights over the material, unless that party agrees to posting the material on our site, and to our Terms and Conditions, with a written (emailed) consent. In other words, members whose material is under contract with a different publisher and who have a specific copyright agreement with that publisher prohibiting any reproduction will not be able to upload their material to Bibliocracy.com. It is the sole responsibility of all members to ensure that if they decide to upload their material to our site that they are not contravening any agreement that they may have with another publisher.

A4 – That you the member (author or artist) are solely responsible for pursuing anyone who distributes your material, (outside of Bibliocracy.com) for the purpose of profit, or non-profit.

A5 – Our eBooks are Digital Rights Management (DRM) free.  

A6 – That you the member cannot hold Bibliocracy.com and its owner accountable for any copyright infringement for any work published on the site. For any intellectual or proprietary infringement that you may find, please contact us, so that we may assess the claim and remove the material if we conclude that infringement has occurred.     

 A7  –  Using the Invite Friends  Feature: Unlawful use of  this application will result in immediate revocation of your membership.That you will be held liable and responsible for any spam or misuse of the tool, including legal repercussions. The Bibliocracy.com Team monitors the use of this tool very carefully, and will enforce legal action against any misuse.

A8  –  Using the Post Job Opportunities, Advertise Your Skills & Market Your Capabilities, as a member, visitor and/or end user of the information found and included in these posts you agree and understand that Bibliocracy.com does not verify the accuracy of job posts, nor represent in any shape or form the users. You the member use this service as is and without preconditions. You agree that only submissions in PDF format will be uploaded to the site. You agree that all submissions will be deleted after 90 days or if member requests posting / advertisement to be deleted prior. You agree that you may provide any personal or business contact information in the document you submit with the understanding and full agreement that this page will be accessible and viewed by all members and public visitors to Bibliocracy.com. You agree that there should be no expectation of any privacy for the information you submit for Bibliocracy.com to post (on publicly accessible pages) on this site. By using this service, you agree to the Bibliocracy.com Terms and Conditions.

A9 - Bibliocracy.com reserves the right to use and to publish (current and past) members positive feedback and testimonials about Bibliocracy.comand the service of the website on the site. Bibliocracy.com also reserves the right to use members feedback in any marketing and promotional campaigns and in any medium as decided on by Bibliocracy.com. Any marketing or promotional campaigns includes but not limited to: websites, social media sites, digital ads, radio, television, all print mediums, including all interviews. Bibliocracy.com also reserves the right to use members eBook covers and Cover Art to advertise our members products and to market and advertise Bibliocracy.comin our social media accounts (i.e Facebook) and any other platform that may support the marketing initiatives of Bibliocracy.com

A10 - In Becoming a Member, visiting or using the services and/or purchasing a product or service on Bibliocracy.com you agree to the Privacy Policy of this site.

B. Terms of Site Use

B1 – All prices quoted on Bibliocracy.com are in U.S. dollars (USD).

B2 – When you visit Bibliocracy.com, subscribe to a service or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically which may also include but not limited to emails confirming payment, unauthorized site use, changes to terms and conditions and replies to a member’s question(s). We will communicate with you by email, through the Bibliocracy Muse or by posting notices on this site.

B3 – You agree to use our site (Bibliocracy.com) responsibly. You will not upload viruses, malware, spyware, or other malicious code. This will result in permanent revocation of your membership. Furthermore, any data theft caused by your actions will result in revoking your membership, as well as criminal pursuit by national authorities and Interpol. We reserve the right to also file a severe class action suit, for punitive damages resulting in; and not limited to compensation owed for theft of material, as well as all legal fees, and cost of lost operations revenue based on our profits.  

B4 – The name Bibliocracy.com and its logo are  proprietary ownership of the site owner. You shall not use our website name and (or) logo for advertising, or sale, without the prior consent of the website owner. That you shall not copy the format of the site as it is first used by our incorporation, without permission or; prior consent from the website owner; in doing so you infringe on the owner’s exclusive intellectual rights to the site, which may result in legal action. Members are authorized to link from their site to Bibliocracy.com. However, material uploaded shall not contain the name, website address or any particular information of a publishing competitor.

B5 – The entity Bibliocracy.com and its owner cannot be held liable under any circumstance, for any damage resulting to your property, software or hardware, this also includes damage from uploading content, virus, malware, or any other circumstance resulting from the event of using our site. That you understand that you cannot hold Bibliocracy.com or its owner responsible for any damage incurred or loss of revenue from its use.

B6 – Bibliocracy.com, its script, its programming and its look are protected under intellectual property rights.

B7 – At Bibliocracy.com, you will have the opportunity to upload your eBook to our site and make a Royalty equal to 85% of the net proceeds on your sales. Net proceeds means that there is a deduction of: 3.9% PayPal Transaction Fee, a $0.35 cents PayPal Fixed Fee, and a fixed delivery charge of $0.10 cents (5Mb File Size Limit) charge per product sold. You also agree that there may be other miscellaneous expenses that may decrease the royalty paid out to you, this may be as a result of (other payment processing fees, costs due to erroneous or fraudulent transactions, credit card charge-backs and associated fees).  All eBook sales up to and including the 21st of each month will be paid on the last day of that month. All eBook sales after the 21st will be paid out on the last day of the following month. All royalties generated by our members will be paid directly to their PayPal account.

B8 - You agree that the price you can charge for you eBook must be minimum $0.99 and cannot be more than 5Mb in size. All eBooks uploaded to Bibliocracy.com must be in Microsoft Word Document Format, and must not reference a competitor publishing company.

B9 – At Bibliocracy.com, members also have the opportunity to upload their unique Cover Art to our site and make a Royalty equal to 85% of the net proceeds on your sales. Net proceeds means that there is a deduction of: 3.9% PayPal Transaction Fee, a $0.35 cents PayPal Fixed Fee, and a fixed delivery charge of $0.10 cents (5Mb File Size Limit) charge per product sold. You also agree that there may be other miscellaneous expenses that may decrease the royalty paid out to you, this may be as a result of (other payment processing fees, costs due to erroneous or fraudulent transactions, credit card charge-backs and associated fees). All Cover Art sales up to and including the 21st of each month will be paid on the last day of that month. All Cover Art sales after the 21st will be paid out on the last day of the following month. B10 – You agree that all Cover Art illustrations uploaded to Bibliocracy.com are required to be uploaded in JPEG or TIFF Format and cannot be more than 4Mb in size. You must also ensure that any Cover Art illustrations that you upload to our site is your final version. By uploading a Cover Art with Bibliocracy.com, you also acknowledge and agree that it is a unique Cover Art and is not being sold or offered anywhere else (and has not been sold before). That the purchaser will be buying a one-of-a-kind eBook Cover.

B11 - Professional looking eBook covers uploaded by authors with their eBook and Cover Art uploaded by artists have a better chance of being on the Home Page.

B12 - All members understand and agree that the 85% of net proceeds Royalty payment to members may change without prior notice. You also agree that if Bibliocracy.com establishes and engages into an agreement with a third party(ies) or an affiliate program to further expand its distribution channels with the intent to provide our members more access to sell their products that the Royalty paid to members may decrease in order to be able to participate in these new distribution channels. You also agree that depending on where your product is sold in the world, that specific countries may have different tax laws and as such, any sales taxes collected will have to be paid out to the respective tax authorities in those countries.

B13 - You also agree that if you are required to pay (including but not limited to) personal, corporate or business income taxes (on any royalties or earnings your earn from selling your products on Bibliocracy.com, including but not limited to eBooks and Cover Art) in your country of residence (for tax purposes), that it is your sole responsibility to declare any royalties or earnings you earn as a result of your membership with Bibliocracy.com and it is your responsibility to pay any taxes owing. Bibliocracy.com does not provide any tax or accounting support or advice regarding your membership with us.          

B14 – At Bibliocracy.com you will also have the option to have 10% of your eBook previewed (and limited to no more than 50 pages) by prospective buyers for free. Members can also choose to upload a personal picture of themselves at no cost. Members will also have the option to link to a video from any multimedia site explaining their eBook or eBook Cover Art to prospective buyers. Members must ensure that the content of their video abides by the Bibliocracy.com Terms and Conditions. Videos that do not comply will have their links removed from the Bibliocracy.com website without prior notice.

B15 –Anyone over the age of 18 years old, may purchase an eBook cover through Bibliocracy.com from members (artists) that have uploaded their eBook Cover Art illustration(s) for sale.    

B16 – Once a member has sold an eBook Cover Art illustration on our site, it cannot be re-sold to someone else on Bibliocracy.com again. It is important for the artist to understand that they price their image accordingly, since they will no longer own the eBook Cover Art illustration once sold. Once an artist has sold an eBook cover illustration on our site, it belongs to the buyer. The buyer is purchasing the image, and as such can use the image as they choose.

Note – Ensure that the Cover Art illustration you are uploading is your final version.  

B17 - All sales are final, please ensure that the item(s) that you are purchasing is(are) accurate (correct product and right amount).

B18 – You may also request to have one of our in-house artists create a Professional eBook Cover Art specifically for your eBook. The final product (Professional eBook Cover Art) will belong to the buyer and not to Bibliocracy.com or to the in-house artist who created it. Depending upon your request, completion of said artwork will vary depending upon the complexity of the artwork. Our goal is to complete all requests within a 16 business days, and within five business days if a review was requested. All reviews (if required), must be for minor changes only to the original request. The first and second reviews (if required) are free and have to be accompanied with the changes requested (maximum of 200 and 100 words respectively). You agree that all additional reviews cost $25 (are non-refundable) and have to be accompanied with the changes requested (maximum 100 words). 

B19 – Bibliocracy.com reserves the right to refuse service to any customer or prospective customer for any reason and without explanation. Bibliocracy.com also reserves the right to terminate all services and contractual obligations with a customer in the event of the customer violating any of the terms and conditions contained herein. Note: that Bibliocracy.com will not accept resubmission of any work which has been removed or asked to be removed by it's author, and that for a grace period of 6 months, and at Bibliocracy.com's discretion.
